Pixpat Terms of Service

These Terms of Service ("Terms") govern your use of Pixpat (the "Platform," "we," "us"), a marketplace for buying and selling digital sewing patterns, and related courses. By creating an account or using the Platform, you agree to these Terms.
Pixpat operates as a marketplace connecting independent pattern makers ("Sellers") with sewists ("Buyers"). Please read the section that applies to you carefully. If you are both a buyer and a seller, both sections apply to you.
1. General Terms (All Users)
1.1 Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and make purchases or sales on Pixpat.
1.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
1.3 Digital Products
All products sold on Pixpat are digital goods (PDF sewing patterns, video/text courses, and related digital files). Nothing physical is shipped.
1.4 Prohibited Conduct
You may not use the Platform to: infringe on intellectual property rights; upload malicious files; harass other users; circumvent payment systems; or resell, redistribute, or share purchased digital files outside the scope of your personal license (see Section 2.4).
1.5 Changes to These Terms
We may update these Terms from time to time. We'll notify users of material changes via email or a platform notice. Continued use after changes take effect constitutes acceptance.
1.6 Limitation of Liability
The Platform is provided "as is." To the maximum extent permitted by law, Pixpat is not liable for indirect, incidental, or consequential damages arising from your use of the Platform, including errors in patterns, course content, or sizing.
2. Terms for Buyers
2.1 Purchases
When you purchase a sewing pattern or course, you are entering into a transaction with the individual Seller who created and listed that product. Pixpat facilitates the transaction, payment processing, and file delivery, but is not the seller of record for marketplace listings.
2.2 Instant Digital Delivery & Refunds
Because patterns and courses are delivered digitally and instantly, all sales are final once a file has been downloaded or a course has been accessed, except where:
The file is corrupted, missing pages, or otherwise not as described;
You were charged in error or charged twice for the same item;
The Seller offers a more generous refund policy on their listing (Seller-specific policies, where stated, override this default).
To request a refund under these exceptions, contact us within [7/14] days of purchase at [support email].
2.3 Accuracy of Patterns and Courses
Sellers are solely responsible for the accuracy of their pattern grading, sizing, instructions, and course content. Pixpat does not test, grade, or verify pattern files before they are listed. If you encounter a significant error, please report it so we can flag it with the Seller.
2.4 License to Use Purchased Files
When you purchase a pattern or course, you receive a personal-use license, which means you may:
Print and use the pattern to make garments for yourself, as gifts, or for sale in small quantities as finished garments (unless the Seller's listing states otherwise, e.g., "digital file only, no commercial garment sales");
Access course content for your own learning.
You may not:
Share, resell, or redistribute the PDF file or course materials themselves;
Upload the pattern or course content to file-sharing sites, forums, or other marketplaces;
Claim the pattern design or course content as your own.
Specific commercial-use terms (e.g., limits on how many garments you may sell) are set individually by each Seller and shown on the product listing. Where a Seller has not specified otherwise, small-batch commercial sewing (home-based, limited quantity) is permitted, but mass production, digitizing, or reselling the pattern itself is not.
2.5 Technical Requirements
You are responsible for having software capable of opening PDF files and, where relevant, a printer or copy shop access to print patterns at full scale. Pixpat is not responsible for print-shop errors or scaling mistakes made outside the Platform.
2.6 Course Access
Course purchases grant you ongoing access to the course content for as long as it remains published on the Platform and your account remains in good standing, unless the listing specifies a limited access window (e.g., "12 months access").
3. Terms for Sellers
3.1 Who Can Sell
Sellers must be the original creator of the patterns and course content they list, or hold documented rights/license to sell that content. By listing a product, you represent and warrant that you own or have the rights to all designs, instructions, photos, and materials included.
3.2 No Exclusivity
Pixpat does not require exclusivity. You are free to sell your patterns and courses on your own website, other marketplaces, or anywhere else, simultaneously with listing them on Pixpat. We believe you should own your relationship with your customers and your distribution.
3.3 Pricing
You set your own prices. Pixpat does not dictate, cap, or discount your prices without your consent. You may change your prices at any time. Any promotions or sitewide sales are opt-in for Sellers, not automatic.
3.4 Marketplace Fee
Pixpat charges a flat 10% marketplace fee + $0.50 per product sale on the sale price of each transaction, covering payment processing, hosting, file delivery, and platform maintenance. You keep 90% of every sale minus the $0.50 per-product-sale fee. There are no listing fees, monthly fees, or hidden charges.
3.5 Payouts
Payouts are issued to your connected payment account on a monthly basis. Each sale is held for a 60-day retention period from the date of purchase before it becomes eligible for payout, to allow time for chargebacks or payment disputes to be resolved. Payouts are net of the marketplace fee and any applicable payment processor fees. You are responsible for providing accurate payout information and for any taxes owed on your earnings.
3.6 Your Content
You retain full ownership and copyright of your patterns, designs, course content, photos, and written materials at all times. Listing a product on Pixpat grants us a limited, non-exclusive license to host, display, and deliver that content to Buyers who purchase it — nothing more.
3.7 Refund Responsibility
If a refund is issued under Section 2.2 due to a legitimate product issue (corrupted file, mis-described item), the Seller's payout for that transaction will be reversed accordingly. Sellers may set a more buyer-friendly refund policy on their own listings, which will be honored over the platform default.
3.8 Quality & Listing Standards
To keep the marketplace trustworthy for Buyers, Sellers agree to:
Accurately describe sizing, fabric requirements, skill level, and file contents;
Only upload files that are complete and print-ready (or clearly marked as drafts/betas if applicable);
Respond to reasonable Buyer support questions about their own patterns/courses in a timely manner.
3.9 Removal of Listings
You may unpublish or delete your own listings at any time. Buyers who purchased before removal retain access to their already-purchased files. Pixpat reserves the right to remove listings that violate these Terms, infringe on third-party rights, or receive credible complaints of plagiarism or fraud.
3.10 Termination
Either party may close a Seller account at any time. Outstanding payouts owed at the time of closure will still be paid out on the normal payout schedule.
4. Intellectual Property & Copyright
Pixpat respects intellectual property rights and expects Sellers to do the same. If you believe a listing infringes your copyright or design rights, contact us at [legal/support email] with details, and we will investigate and remove infringing content where warranted.

These Terms are governed by the laws of [jurisdiction], without regard to conflict-of-law principles.
